Marketplace Liability & Disclaimer Policy
IMPORTANT: This policy clarifies HanyMarket's role and limitations as a marketplace platform. Please read carefully.
7.1 Marketplace Only
HanyMarket is a digital marketplace platform that connects buyers and merchants.
HanyMarket is NOT:
- A seller of products or services
- A delivery or logistics service
- A warehouse or storage facility
- A manufacturer or producer
- A contracting party in transactions
HanyMarket ONLY provides a digital meeting place where independent merchants can list products and buyers can browse and purchase.
7.2 No Control Over Merchants
HanyMarket does NOT:
- Control merchant operations
- Guarantee delivery
- Guarantee product authenticity
- Guarantee refunds
- Mediate disputes (optional only, at our discretion)
- Verify product quality
- Manage merchant inventory
- Control pricing
Each merchant operates independently and is solely responsible for their business practices, product quality, and customer service.
7.3 No Liability
HanyMarket is not liable for:
- Financial losses from transactions
- Product damages or defects
- Late, failed, or non-delivery
- Transaction disputes between buyers and merchants
- Health or safety issues from purchased goods
- Misrepresentation by merchants
- Fraudulent activities by users
- Payment processing issues
- Data breaches by third parties
- Loss of profits or business
- Indirect or consequential damages
7.4 Merchant-Buyer Relationship
All transactions on HanyMarket create a direct contractual relationship between the buyer and the merchant only. HanyMarket is not a party to these transactions.
Disputes, refunds, returns, warranties, and all post-purchase matters are to be resolved directly between buyers and merchants.
7.5 Indemnity
Users agree to indemnify and hold harmless HanyMarket, its owners (Hanypay Ghana Ltd.), affiliates, partners, employees, and agents from:
- All claims and demands
- Losses and damages
- Legal costs and expenses
- Liabilities
arising from or related to:
- Merchant misconduct or negligence
- Buyer misconduct
- Violation of these terms
- Transactions on the platform
- Use or misuse of the platform
7.6 Maximum Liability
To the fullest extent permitted by law, HanyMarket's maximum liability for any claim shall not exceed the service fees paid by the user to HanyMarket in the 12 months preceding the claim.
7.7 Third-Party Services
HanyMarket integrates with third-party payment processors and other services. We are not responsible for the actions, policies, or failures of these third parties.
7.8 Platform Availability
While we strive for continuous availability, HanyMarket does not guarantee uninterrupted or error-free platform access. We may suspend or modify services for maintenance, upgrades, or other reasons without liability.
7.9 Force Majeure
HanyMarket is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or fuel shortages.
Final Acknowledgment: By using this platform, you acknowledge that HanyMarket is a marketplace-only service provider and agree that all transactions are strictly between buyers and merchants. HanyMarket bears no responsibility for product delivery, quality, or dispute outcomes. You understand and accept that HanyMarket's role is limited to providing a platform for connecting buyers and merchants, and that we do not participate in, control, or guarantee any aspect of transactions.
